Trolley'd Event Services: Terms and Conditions

These Terms and Conditions ("Terms") govern the agreement between Trolley'd ("We," "Us," "Our") and the Client ("You," "Your") for the provision of mobile bar services at your event ("Event"). By engaging our services, you agree to be bound by these Terms.

1. Booking and Payment

1.1 Booking Confirmation

  • A booking is considered confirmed once a signed contract and a non-refundable deposit of 50% of the total fee are received by Trolley'd.
  • The remaining balance is due no later than 7 days prior to the Event date.

1.2 Payment Terms

  • Payments can be made via bank transfer, credit card, or other agreed methods.
  • Credit Card Fees: Payments via credit card will incur a processing fee of 1.75% with Stripe or 2.9% with Square. These fees do not apply to direct debit or cash payments.
  • Please note the flight number (invoice reference) when making any payments to ensure your payment is correctly allocated.
  • Late payments may result in the cancellation of services, and any costs incurred will be charged to you.

1.3 Cancellations and Refunds

  • In line with industry standards, deposits are non-refundable but are transferable to another event date, subject to availability. However, any out-of-pocket expenses incurred that cannot be transferred to the new date will be charged.
  • Cancellations made more than 30 days before the Event: The deposit is forfeited, but no further charges will apply. If the deposit is transferred to a new date, any out-of-pocket expenses that cannot be transferred will still be charged.
  • Cancellations made within 30 days of the Event: 50% of the total fee will be charged. If the deposit is transferred to a new date, any out-of-pocket expenses that cannot be transferred will still be charged.
  • Cancellations made within 7 days of the Event: The full amount will be charged. If the deposit is transferred to a new date, any out-of-pocket expenses that cannot be transferred will still be charged.
  • Any refunds, if applicable, will be processed within 14 days of the cancellation notice.

1.4 Additional Charges

  • Travel Fees: Events occurring 30km or more from the Sydney CBD or Southern Highlands will incur an industry standard fee of $1.50 per km. An hourly travel rate for staff will also apply.
  • Parking Costs: Should parking costs be incurred at the venue, these will be included in the final invoice.
  • After Midnight Loading: For events that go past midnight, a 20% loading on staff rates will be charged for every hour post-12:00 AM.

2. Event Details and Requirements

2.1 Event Information

  • You must provide all relevant event details, including date, time, location, number of guests, event style, and any special requests, at least 30 days prior to the event for under 200 guests and at least 60 days prior for larger events.
  • Any changes to the Event details must be communicated in writing and may incur additional charges.

2.2 Guest Numbers

  • The quoted price is based on the number of guests provided at the time of booking. Any significant increase in guest numbers must be communicated at least 14 days before the Event and may result in additional charges.

2.3 Venue Requirements

  • You are responsible for ensuring that the venue is suitable for Trolley'd to operate, including access to power, water, and waste disposal facilities.
  • If the venue requires special permissions, such as noise permits or additional licences, you must obtain these at your own expense.

2.4 Alcohol Provision

  • We will provide a selection of alcoholic and non-alcoholic beverages as agreed upon at the time of booking.
  • No outside alcohol is permitted to be served by Trolley'd unless agreed in writing prior to the Event.

3. Licensing and Compliance

3.1 Liquor Licence

  • Trolley'd operates under a valid On-Premises Liquor Licence. If additional licences are required for your Event, you must notify us at least 30 days in advance so that we can assist in obtaining the necessary licences. Additional fees may apply.
  • We reserve the right to refuse service if we believe the licensing requirements are not being met or if the Event is in violation of local liquor laws.

3.2 Responsible Service of Alcohol (RSA)

  • All Trolley'd staff are RSA-certified and are obligated to serve alcohol responsibly. We reserve the right to refuse service to intoxicated guests or minors.
  • We will not be held responsible for any issues arising from the consumption of alcohol, including but not limited to overconsumption, drink-driving, or related incidents.

3.3 Noise Restrictions

  • You must inform us of any noise restrictions at the venue. If noise restrictions are in place, we will work to ensure compliance but are not responsible for any penalties incurred due to noise violations.

4. Health and Safety

4.1 Public Liability Insurance

  • Trolley'd holds public liability insurance to cover incidents directly caused by our services. A copy of our insurance certificate can be provided upon request.
  • You are responsible for ensuring the venue complies with health and safety regulations.

4.2 Safety Measures

  • We will take all reasonable steps to ensure the safety of guests and staff during the Event. This includes adhering to fire safety regulations and ensuring that bar equipment is safely set up and operated.
  • You must inform us of any specific health and safety requirements of the venue.

4.3 Emergency Procedures

  • In the event of an emergency, our staff will follow the venue's emergency procedures. You must ensure that all guests are aware of emergency exits and procedures.

5. Damage and Liability

5.1 Damage to Property

  • You are responsible for any damage to our equipment or property caused by guests during the Event. Repair or replacement costs will be billed to you.
  • Glassware: Lost or broken glassware will be charged at $6.50 per glass. No breakage fee will apply if the glassware is found and returned to Trolley'd within 14 days of the Event. *No charge will be apply if Trolley’d crew are deemed to be at fault.
  • Other Equipment: Charges for lost or damaged equipment will be in accordance with the terms set out in the agreement.

5.2 Force Majeure

  • Trolley'd will not be held liable for any failure to perform its obligations where such failure is due to circumstances beyond our control, including but not limited to acts of God, war, terrorism, government restrictions, strikes, or natural disasters.
  • If the Event is cancelled due to force majeure, we will work with you to reschedule the Event or provide a refund minus any expenses already incurred.

6. Privacy and Data Protection

6.1 Data Collection

  • We collect and store personal information provided by you for the purpose of managing the Event. This information will not be shared with third parties without your consent, except where required by law.

6.2 Marketing

  • We may use photographs and details of the Event for marketing purposes, unless you request otherwise in writing. Any request to not use Event details for marketing must be made prior to the Event.

7. Dispute Resolution

7.1 Governing Law

  • These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

7.2 Resolution Process

  • In the event of a dispute, both parties agree to first attempt to resolve the issue through negotiation or mediation before pursuing legal action.

8. Miscellaneous

8.1 Amendments

  • Trolley'd reserves the right to amend these Terms and Conditions at any time. Any amendments will be communicated in writing and will not affect confirmed bookings unless required by law.

8.2 Entire Agreement

  • These Terms and Conditions, along with the signed contract and any written amendments, constitute the entire agreement between Trolley'd and the Client.

8.3 Severability

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

9. A Note to Customers

9.1 Availability and Booking

  • At the time of issuing this quotation, we do have availability for the time and date of your event; however, due to the high demand for our services, this is subject to change without notice.
  • We encourage you to confirm your booking as soon as possible by notifying us so we can issue an invoice. A 50% deposit is required to lock in your booking.

9.2 Crew Arrival

  • Due to unforeseen circumstances, crew arrival times can sometimes be delayed. If timely arrival is of the highest priority, please inform our bookings team in advance.

By engaging Trolley'd for your Event, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
